Hamdi Alqudsi is accused of assisting with the travel arrangements for seven young men who went to fight for ISIL in Syria in 2013. He today faced the NSW Supreme Court to make an application to change his bail conditions.
Mr Alqudsi’s lawyer, Zali Burrows, requested he be able to live in the Suburban Islamic Association’s Minto mosque from July 7-17, so he could observe the requirements of Ramadan.
Ramadan is considered the holiest month of the year by Muslims and is designated as the ninth month of the year based on the Islamic or Hijri calendar.
During the holy month Muslims do not eat or drink during daylight hours and are typically required to refrain from smoking cigarettes, swearing and having sex.
The Crown challenged the application, saying “a house of worship is not a place of residence” and arguing it could be hard for police to check on the accused and ensure he was keeping his bail conditions.
But Ms Burrows said the mosque was likely under constant surveillance by law enforcement authorities.
The prosecution alleges Mr Alqudsi helped seven ISIL converts travel to Syria between June and October 2013.
Justice Robert Beech-Jones allowed the change in bail conditions.
Mr Alqudsi will be required to live and sleep in the mosque, keeping a daily curfew between 10pm and 5am and will report to police daily as part of his bail conditions.
He will face trial in September.
